Os desafios à implantação do modelo de gestão dos recursos hídricos estabelecidos pela lei 9.4333

Abstract

This article objectified to identify the main challenges to the implementation of the system of management of the water features established by Law 9.433/97, in special the restrictive factors to the installation of Committees of Basin and Hidric Resources Agencies and the challenges to the implementation and management of the basin plans, of the charge and the grant for the hydric resources uses. The analysis is based in the South Paraiba river case, beyond the experience in other countries. The reflections on the gotten information had led to the conclusion of that the magnifying and change of the institucional base of decision, the integration of the entities of water features, the institucional qualification and technique, the social mobilization, the decentralization of the financial features, the integration of the management in frontier basins and the implementation of management systems based in the consensus are the biggest challenges to the execulte of the federal law.

O estudo objetivou identificar os principais desafios à implementação do sistema de gestão dos recursos hídricos estabelecido pela Lei 9.433, em especial os fatores restritivos à instalação de Comitês de Bacia e Agências de Água e os desafios à implementação e gestão dos planos de bacia, da cobrança e da outorga pelo uso dos recursos hídricos. A análise tomou por base o caso do rio Paraíba do Sul, além da experiência de outros países. As reflexões sobre as informações obtidas levaram à conclusão de que a ampliação e mudança da base institucional de decisão, a integração das entidades de recursos hídricos, a capacitação institucional e técnica, a mobilização social, a descentralização dos recursos oriundos da cobrança, a integração da gestão em bacias transfronteiriças e a implementação de sistemas de gerenciamento baseados na busca do consenso são os maiores desafios à efetivação da lei federal.
