A reinvenção do papel do cartório de imóveis na era da tecnologia blockchain: uma investigação exploratória

Abstract

O início do século XXI é marcado por um rápido desenvolvimento de tecnologias da informação. Uma das mais recentes criações é a blockchain. O uso da tecnologia vem ganhando popularidade em todo o mundo e essa tendência global tem afetado diversas áreas. Ao empreender este projeto, havia cinco objetivos iniciais: (i) mapear o estado do conhecimento e uso da tecnologia blockchain atualmente sendo empregado em registro de imóveis em âmbito global; (ii) investigar por que a tecnologia blockchain está (ou não) sendo utilizada no Brasil e mundo; (iii) explorar se há potencial para uso da blockchain no processo registral brasileiro; (iv) pesquisar o arcabouço regulatório de registro de imóveis, a fim de compreender se atualmente há restrições para a aplicação da tecnologia blockchain; e, (v) introduzir parâmetros que auxiliem na análise da efetividade de futura aplicação da tecnologia. A escolha da pesquisa qualitativa como metodologia de investigação se sustenta pela necessidade de avaliar situações polissêmicas e de baixa teorização para o tema em desenvolvimento. Ao conferir suporte teórico, documental e doutrinário para as proposições e permitindo a construção de inferências válidas com base na análise de textos e entrevistas abertas com agentes do setor, propiciando um importante caminho para o acesso às informações desejadas e consequente fortalecimento do conhecimento acadêmico. A blockchain representa uma mudança potencialmente disruptiva na forma como os atividades registrais operam. Pesquisas adicionais são necessárias para acompanhar a prática e políticas envolvidas. Esse trabalho representa a evidência inicial sobre o que promete ser um fenômeno importante e frutífero no estudo de novas possibilidades para o sistema cartorário.

The early 21st century is marked by the rapid development of information technologies. One of the latest creations is a blockchain. The use of technology has been gaining popularity all over the world and this global trend has undergone several areas. In undertaking this project there were five initial objectives: (i) to map the state of knowledge and use of blockchain technology currently being used in real estate registration at a global level; (ii) investigate why blockchain technology is or is not being used; (iii) to explore whether there is potential for blockchain use in the Brazilian registration process; (iv) research the regulatory framework for real estate registration, in order to understand if there are currently restrictions on the application of blockchain technology; and, (v) introduce parameters that help in the analysis of the effectiveness of future technology application. The choice of qualitative research as a research methodology is based on the need to evaluate polysemic situations and low theorization for the topic under development. Providing theoretical, documentary and doctrinal support for propositions and allowing the construction of valid inferences based on the analysis of texts and open interviews with agents of the sector, providing an important path for access to desired information and consequent strengthening of academic knowledge. The blockchain represents a potentially disruptive change in the way recordkeeping activities operate. Additional research is needed to follow the practice and policies involved. This work represents the initial evidence on what promises to be an important and fruitful phenomenon in the study of new possibilities for the registry system.
