A judicialização de políticas regulatórias de telecomunicações no Brasil

Abstract

The article presents the results of a research about the judicialization of telecommunications regulatory policies in Brazil. It begins by describing, in general terms, the main relevant aspects of the organization of the telecommunications sector and the role played by Anatel, besides the methodological aspects of the research. Among the results, it observed the existence of 48 lawsuits, the vast majority being proposed by consumer protection organizations. Furthermore, most of the actions identified dealt with specific issues of lateral impact on the telecommunications policies.

O artigo apresenta os resultados da pesquisa de decisões judiciais a respeito das políticas regulatórias de telecomunicações no Brasil. O trabalho começa por descrever, em linhas gerais, os principais aspectos institucionais pertinentes à organização do setor de telecomunicações e ao papel nele exercido pela Anatel, além dos aspectos metodológicos da pesquisa. Dentre os resultados, observa-se a existência de 48 ações judiciais, sendo a grande maioria proposta por entidades de proteção e defesa do consumidor. Além disso, a maior parte das ações identificadas tratou de temas pontuais e de impacto lateral na política de telecomunicações.
