O conceito de direito no metaverso: uma análise a partir de H. L. A. Hart

Abstract

Este trabalho busca explorar a possibilidade de identificação no Metaverso, tal qual caracterizado por Silvio Meira, dos elementos do Direito descritos por Herbert Hart em sua obra “O Conceito de Direito”. Para tanto, sintetizou-se o que se entende por Direito na teoria hartiana e se elencaram as dez qualidades necessárias do Metaverso, de forma a constatar eventual ponto de incompatibilidade entre ambos. Recorreu-se à noção de governança interna da blockchain, proposta por Karen Yeung e David Galindo Chacon, para analisar as estruturas internas do Metaverso que podem conflitar com o Direito, em oposição a eventual tentativa de regulação estatal. Concluiu-se, finalmente, que grande parte das características propostas para o Metaverso não conflitam com o Direito quando observadas isoladamente, havendo atritos, no entanto, com a necessidade de descentralização e distribuição inerentes a essa nova forma de organização social.

This paper seeks to explore the possibility of identifying the Law elements described by Herbert Hart in his work "The Concept of Law" in the Metaverse as characterized by Silvio Meira. To this end, it was synthesized what is understood as Law in Hart's theory and then the ten required qualities of the Metaverse were listed in order to verify a possible point of incompatibility between the two. The notion of internal governance of the blockchain, proposed by Karen Yeung and David Galindo Chacon, was used to analyze the internal structures of the Metaverse that may conflict with Law, in opposition to a possible attempt at state regulation. Finally, it was concluded that most of the characteristics proposed for the Metaverse do not conflict with the Law when observed in isolation, although there are frictions, nevertheless, with the need for decentralization and distribution inherent to this new form of social organization.
