Narrativas e experiências em justiça restaurativa na cidade do Rio de Janeiro

Abstract

A presente dissertação apresenta narrativas e experiência da Justiça Restaurativa na cidade do Rio de Janeiro, por meio do olhar de quem julga, de quem faz e de educa. A hipótese de partida é de que cada um desses atores traz consigo suas histórias e percepções sobre as práticas em construção, conforme acontece nos demais estados do Brasil e países do mundo. Para verificá-la, realizou-se uma revisão da literatura sobre Justiça Restaurativa no Brasil e mundo. A seguir, analisou-se as entrevistas realizadas com base no roteiro estruturado inicialmente para a construção de um acervo de história oral. Concluiu-se, por fim, que falar sobre Justiça Restaurativa é primeiro ter a clareza de que não há uma definição fechada sobre o que seja; é um constante construir, pois primeiro surgiram as experiências, depois a teorização sobre esse fazer. É uma tecnologia jurídica potente para trocar as lentes daqueles que atuam na estrutura da Justiça, reverberando também naqueles que utilizam esse serviço ``dentro`` ou ``fora`` dela, impactando a forma como desejamos olhar para os conflitos, para os danos, para as nossas dores e relações.

The present dissertation presents narr atives and experiences of Restorative Justice in the city of Rio de Janeiro, through the e yes of those who judge, who practice and teach about it. The starting hypothesis is that each person involved brings with them their stories and perceptions about the practices under construction, as it happens in other states of Brazil and countries of th e wo rld. To verify it, a research and review of the literature on Restorative Justice in Brazil and in the world was made. Then, the interviews were analyzed based o n the script initially structured for the construction of a collection of oral history. Th e co nclusion was that to speak about Restorative Justice is necessary to have the clarity that there is no closed definition of what it is; is a constant construction ; first the experiences and facts arise. Only after then the theorizing about what to d o begi ns. It is a powerful legal technology to change the lenses of those who work in the structure of justice, transforming those using this service directly and indi t hey rectly and impacting how we want to look at conflicts, damages, pain, hardships and how all relate.
