Os impactos do PLP 134/2019 para as instituições de educação e para as políticas educacionais

Abstract

Está atualmente em trâmite (aguardando sanção presidencial) o Projeto de Lei Complementar nº 134/2019 que visa disciplinar a Certificação de Entidade Beneficente de Assistência Social, conferindo às entidades certificadas o direito à fruição da imunidade às contribuições para a Seguridade Social. O PLP 134/2019 é de extrema relevância para as instituições sem fins lucrativos atuantes nos campos da educação, assistência social e saúde e pode impactar diretamente a forma de atuação das entidades e as políticas públicas setoriais. O presente artigo tem por objeto a análise dos impactos do referido PLP 134/2019 em relação às instituições de educação especificamente e seus efeitos nas políticas educacionais, em relação a 5 aspectos: (i) importância das instituições e sua articulação com as políticas já existentes; (ii) instituições contempladas com a Certificação; (iii) perfil dos alunos bolsistas; (iv) atendimento ao princípio da universalidade e (v) valorização de ações em tempo integral. Quanto ao primeiro aspecto, o Projeto de Lei consagra a atuação de instituições de ensino formal que concedam bolsas de estudo, fortalecendo políticas já existentes, a exemplo do Programa Universidade para Todos (PROUNI). Quanto ao segundo aspecto, o Projeto deixa de considerar formas de atuação relevantes para o desenvolvimento da educação no país, tais como ações de promoção da educação – o que implica no fato de que apenas 2% das entidades participantes do censo organizado pelo Grupo de Institutos, Fundações e Empresas em 2020 (CENSO GIFE 2020) tenham declarado ser portadoras da Certificação na área da educação. No tocante ao terceiro aspecto, a Lei tem previsão interessante por privilegiar bolsistas em situação de vulnerabilidade socioeconômica, mas entende-se pela necessidade de que os critérios socioeconômicos sejam definidos regionalmente, considerando-se também critérios étnico-raciais, e outros que possam contribuir para instituições mais diversas e inclusivas. Assim, quanto aos aspectos terceiro e quarto, identifica-se que a Lei pode ser aprimorada para que seja mais propositiva quanto a ações de diversidade e inclusão, ainda que o PLP valorize bolsas de estudo concedidas para pessoas com deficiência. Por fim, quanto ao último aspecto, é relevante mencionar que a Lei valoriza ações de tempo integral, em conformidade com as melhores práticas internacionais sobre a importância da jornada integral e com as experiências nacionais sobre o assunto.

Bill No. 134/2019 is currently awaiting presidential approval. The Bill aims to regulate the Certification of Beneficent Social Assistance Entities, by granting certified entities immunity from Social Security contributions. PLP 134/2019 is extremely important for nonprofit institutions operating in the fields of education, social assistance and health and can directly impact the way in which entities operate and sector specific public policy. The purpose of this article is to analyze the aforementioned PLP 134/2019 Bill in relation to educational institutions and its impact on educational policies, by focusing on the following 5 points of the Bill: (i) importance of institutions and their connection with existing policies; (ii) institutions covered by the Certification; (iii) profile of scholarship students; (iv) compliance with the principle of universality and (v) full school day. The first point, the Bill establishes the performance of formal education institutions that grant scholarships and strengthening existing policies, such as the University for All Program (PROUNI). The second point, the Bill fails to consider relevant actions for the development of education in the country, such as actions to promote education, what ultimately implies that only 2% of the entities participating in the census organized by the Group of Institutes, Foundations and Companies in 2020 (CENSO GIFE 2020) have declared to be holders of Certification in the area of education. Regarding the third point, the Bill has an interesting provision giving preference to scholarship holders in vulnerable socio-economic situations, (based on socioeconomic criteria to be defined regionally), ethnic-racial criteria and other considerations, that may contribute to more diverse and inclusive institutions. For the third and fourth points, the Bill can be improved to be more purposeful in terms of diversity and inclusion actions, even though the PLP values scholarships granted to people with disabilities. Finally, regarding the last point, it is important to mention that the Bill values full-time actions, in accordance with the best international practices on the importance of full school day and with national experiences on the subject.
