Direito e inteligência artificial: responsabilidade civil e danos físicos causados por veículos autônomos

Abstract

O avanço das tecnologias de Inteligência Artificial tem como objetivo melhorar a qualidade de vida mundial, simplificando processos e aumentando a eficiência em tarefas enfadonhas. Nesse sentido, uma realidade que se torna cada vez mais palpável é a dos carros autônomos, que devem, em algumas décadas, substituir os convencionais. O uso desses veículos cria entraves de cunho ético, técnico e jurídico. Com relação aos últimos, uma das dificuldades parece repousar na identificação dos elementos básicos da responsabilidade civil, que se torna uma tarefa mais árdua diante da independência dos sistemas comandados por IA. Dessa forma, o presente ensaio busca compreender se o ordenamento jurídico atual pode resolver os problemas relativos à responsabilidade civil, garantindo a reparação da vítima de um acidente envolvendo um veículo autônomo, ou se uma mudança legislativa é necessária para enfrentar as mudanças trazidas pelas novas tecnologias.

he progress of Artificial Intelligence technologies aims to improve the quality of life worldwide, simplifying processes and increasing the efficiency of laborious tasks. In that sense, a reality that is becoming more perceptible is the one of autonomous cars, which should, in a few decades, replace conventional ones. The usage of these vehicles creates ethical, technical, and legal barriers. Regarding the latter, one of the challenges seems to lie in identifying the basic elements of civil liability, which becomes a more arduous task given the independence of systems commanded by AI. Thus, this essay seeks to understand whether the current legal system can solve problems related to civil liability, guaranteeing the compensation of the victim of an accident involving an autonomous vehicle, or if a legislative change is necessary to face the changes brought about by new technologies.
