Clareza e legitimidade: como elementos de teoria musical podem iluminar a interpretação jurídica?

Abstract

Analogias entre direito e música, quando ambos são encarados como teorias da interpretação, foram e são muito usadas pela doutrina nacional e estrangeira para a explicação de ideias complexas sobre fenômenos e institutos jurídicos. O trabalho se ocupa de justificar por que essa analogia é tão eficaz, bem como argumentar que ela transcende o seu mero poder pedagógico. O que se busca investigar é como o modo em que direito e música operam se assemelha para além da analogia, sendo que juízes e músicos-intérpretes se colocam diante de crises interpretativas semelhantes e se valem de critérios similares para tomada de decisão. Após a apresentação de quatro casos, dois musicais e dois jurídicos, o trabalho divide-se em duas etapas: a primeira busca apresentar os pontos de conexão em que música e direito se aproximam enquanto teorias de interpretação, justificando a pertinência da analogia; a segunda busca identificar quais valores interpretativos relevantes na música se espelham (ou deveriam se espelhar) no direito.

Analogies between law and music, when both are seen as theories of interpretation, were and are widely used by national and foreign doctrine to explain complex ideas about Law. This work is concerned about justifying why this analogy is so effective, as well as arguing that such analogy transcends its mere pedagogical power. What we seek to investigate is how the way in which law and music operate is similar to an extent that transcends analogy, since judges and music performers face similar interpretive crises and use similar criteria for decision making. After the presentation of four cases, two musical and two legal, this work divides itself into two stages: the first seeks to present the connection points in which music and law come together as theories of interpretation, justifying the effectiveness of the analogy; the second seeks to identify which relevant interpretative values in music are mirrored (or should be mirrored) in Law.
