Teoria da transcendência dos motivos determinantes no direito brasileiro: análise constitucional

Abstract

O objetivo deste trabalho acadêmico é analisar, sob a ótica do Direito Constitucional, a Teoria da Transcendência dos Motivos Determinantes. No contexto de aproximação com o common law, serão destacados os aspectos da Teoria dos Precedentes, em especial a ideia de ratio decidendi. Além disso, a jurisprudência do Supremo Tribunal Federal será destrinchada, a fim de compreender os momentos de aceitação, indecisão e, o que hoje se vivencia, a não adesão a transcendência dos motivos determinantes pela Corte. Dos casos destacados, os argumentos de favoráveis e contrários à Teoria serão estudados. Por fim, o trabalho tratará de argumentos controvertidos que envolvem a Reclamação Constitucional e a atual valorização dos precedentes pelo Novo Código de Processo Civil.

The objective of this academic paper is to analyze, from the point of view of Constitutional Law, the Transcendence Theory of Determining Motives. In the context of approximation with the common law, aspects of the Theory of Precedents will be highlighted, especially the idea of ratio decidendi. In addition, the jurisprudence of the Federal Supreme Court will be disrupted in order to understand the moments of acceptance, indecision and, what is being experienced today, non-adherence to the transcendence of the determining motives by the Court. Of the highlighted cases, the arguments used by the Supreme Court will be studied. Finally, the paper will deal with controversial arguments that involve the Constitutional Complaint and the current valorization of precedents by the New Code of Civil Procedure.
