Resumo

The collection and storage of data on a large scale, combined with the capacity to process them with other data, that do not necessarily have any relation to each other, in order to generate new data and information is a widely used technology nowadays, generally known as Big Data. At the same time it enables the creation of new innovative products and services which meet the demands and solve problems in various sectors of the society, Big Data poses a series of questions related to the rights to privacy and protection of personal data. This article seeks to provide a discussion on the scope of the current legal protection of the rights to privacy and personal data in this context, and thus encourage further studies on the compatibility of them with the freedom to innovate. In this sense, it will first address some of the positives and negatives effects of Big Data, broadly identifying how it affects society and the economy, including, but not limited to, consumer issues, health, social organization, governmental administration etc. Then, it will be identified the effects of this technology on the rights to privacy and protection of personal data, given that Big Data generates major changes with regard to the storage and processing of data. Finally, there will be a mapping of the current Brazilian regulatory framework for the protection of such rights, observing whether it actually responds to the current challenges of reconciling innovation and privacy.
