Chevron Doctrine in Brazil: an alternative to legal uncertainty
Analisa-se neste artigo a possibilidade de se utilizar a Doutrina Chevron como alternativa para o atual problema de insegurança jurídica no direito administrativo no Brasil. Inicia-se o artigo com a evolução do controle judicial sobre o mérito do ato administrativo. Em seguida, aborda-se o problema central da análise: a crise de insegurança jurídica decorrente da amplificação da legalidade, particularmente sentida quando o Poder Judiciário revê decisões proferidas após o devido processo administrativo. Em seguida, passa-se à apresentação de uma proposta de solução com base no direito comparado: a utilização da Doutrina Chevron. Faz-se uma ponderação sobre a necessidade de fortalecimento das instituições no Brasil como condição para a adoção da Doutrina Chevron. Conclui-se que essa doutrina pode ser uma solução interessante a longo prazo para o problema da insegurança jurídica no Brasil.
In this article I assess the possibility of using the Chevron doctrine as an alternative to the current problem of legal uncertainty in the administrative law in Brazil. I begin with the evolution of judicial review of the merit of administrative decisions. Then, I present the main problem to be analyzed: the crisis of legal uncertainty caused by the enlargement of the notion of legality, particularly felt when the Judiciary reviews decisions enacted after the due administrative process. After that, I present a solution proposal based on comparative law: the use of the Chevron doctrine. I consider the need of strengthening the public institutions in Brazil as a condition to the adoption of the Chevron doctrine. In conclusion, I argue that this doctrine can be an interesting solution in the long term to the problem of legal uncertainty in Brazil.
