Interseções entre patrimônio cultural e propriedade industrial: marcas e bens culturais imateriais

A dissertação busca definir o ponto de interseção entre patrimônio cultural e propriedade industrial que corresponde à coincidência entre o ativo marca e os bens imateriais titulados pelo Instituto do Patrimônio Histórico e Artístico Nacional (IPHAN) como integrantes do Patrimônio Cultural do Brasil. Analisa-se o que ocorre nesse ponto: a sobreposição de regimes jurídicos de proteção, com consequentes conciliação ou conflito entre os efeitos de cada um deles. Recorre-se, em princípio, à revisão da bibliografia e da legislação a respeito dos regimes jurídicos de propriedade industrial e de proteção ao patrimônio imaterial. Em seguida, realizam-se estudos de caso, os quais apontam que o cotejamento dos dois regimes jurídicos ocorre mormente quando suscitado por conflito. Suscita-se a proposta de aproximação, antes da verificação de litígios e de controvérsias, entre os dois campos e de aplicação recíproca da legislação especializada. Tem-se com a proposta o objetivo de, de um lado, evitar a apropriação indevida de ativos de propriedade industrial que remetam a bens culturais imateriais titulados como integrantes do Patrimônio Cultural do Brasil, e, de outro, promover a utilização do ativo de propriedade industrial pelas comunidades detentoras do patrimônio cultural imaterial como medida de salvaguarda. This paper seeks to define the point of intersection between cultural heritage and industrial property that corresponds to the coincidence between trademarks and immaterial goods titled by the National Historical and Artistic Institute (IPHAN) as members of the Cultural Heritage of Brazil. What occurs at this point is subject to this work: the overlapping of legal protection regimes, and subsequently conciliation or conflict between the effects of each of them. The analysis begins with the review of the bibliography and legislation regarding the legal regimes of industrial property and protection of intangible heritage. It is followed by case studies, which point out that the comparison of the two legal regimes occurs mainly when raised by conflict. The proposal to bring together, before the verification of disputes and controversies, the two fields and the reciprocal application of specialized legislation is then raised. The proposal has the objective of, on the one hand, avoiding the misappropriation of industrial property assets that refer to immaterial cultural assets titled as part of the Cultural Heritage of Brazil, and, on the other, promoting the use of the same type of asset by the communities that hold intangible cultural heritage as a measure of safeguard.
