Reforma trabalhista de 2017: reflexões sobre o trabalho feminino, políticas públicas e saúde da trabalhadora e impactos sociais

Abstract

Com a reforma trabalhista, realizada no governo do presidente Michel Temer (2016-2018), mais de cem artigos da Consolidação da Legislação Trabalhista (CLT) foram alterados. Diante disso, pretende-se desenvolver um estudo sobre as mudanças geradas pela reforma, principalmente aquelas que impactaram o trabalho feminino em locais insalubres. De modo a subsidiar tal reflexão, pretende-se elencar a trajetória da regulamentação do trabalho feminino no Brasil, considerando seu surgimento legal, e as percepções que envolvam Políticas Públicas de Saúde do trabalhador(a) no Brasil. A fim de alcançar esse objetivo, a metodologia consistiu na pesquisa de obras bibliográficas pertinentes para a temática e análise de normas trabalhistas oriundas das Constituições, Decretos, Medidas Provisórias e da Consolidação da Legislação Trabalhista (CLT). Além disso, foram realizadas entrevistas com profissionais que trabalham em locais insalubres com o objetivo de registrar suas percepções sobre a legislação trabalhista, identificar suas opiniões em relação à proteção de trabalhadoras que atuam nesses locais, além de analisar os impactos sócias gerados.

With the labor reform, carried out under President Michel Temer (2016-2018), more than 100 articles of the Consolidation of Labor Legislation (CLT) were changed. In view of this, it is intended to develop a study on the changes generated by the reform, especially those that impacted female work, who exercise their craft in unhealthy places. In order to support this reflection, it was intended to list the trajectory of the regulation of female labor in Brazil, considering its legal emergence. In order to achieve this objective, the methodology consisted of researching bibliographic works relevant to the theme and analysis of labor standards arising from the Constitutions, Decrees, Provisional Measures and the Consolidation of Labor Legislation (CLT). In addition, interviews were conducted with professionals who work in unhealthy places in order to record their perceptions of labor legislation, identify their opinions on whether or not the legislation is protected for workers who work in these locations.
