O incidente de resolução de demandas repetitivas e o princípio do contraditório

Abstract

O presente artigo se destina a examinar a compatibilidade entre o princípio do contraditório e o Incidente de Resolução de Demandas Repetitivas (IRDR). Assim, o trabalho se propõe a estudar as características particulares do instituto, a natureza do julgamento e a eficácia da decisão proferida em sede de IRDR. Por fim, pretende-se examinar qual seria a adequada aplicação do referido princípio constitucional ao incidente, tendo em vista que a concepção clássica de contraditório não pode ser aplicada aos julgamentos por amostragem.

This work seeks to examine the compatibility between the adversarial principle and the “Incident of Repetitive Actions” (IRA)1 . Accordingly, we propose to study the particular characteristics of the institute, the nature of the judgment and the effectiveness of the decision handed down at the IRA. Furthermore, we will analyze the appropriate application of the adversarial principle to the incident, considering that the classic “right to be heard” cannot be applied for standard procedure trials.
