Aspectos relevantes dos contratos de comercialização de energia elétrica celebrados no ambiente de contratação livre

Abstract

O tema sobre comercialização de energia elétrica no mercado livre regulado é relativamente novo e complexo, e são poucos os agentes e empresas (mesmo que contratantes), que realmente conhecem a fundo o seu funcionamento. Diante da expansão deste mercado, bem como levando-se em consideração a oportunidade de diminuição dos custos com energia elétrica por parte das empresas contratantes e consequente aumento da competitividade, a discussão sobre a regulação do mercado livre é extremamente importante. O presente trabalho busca trazer os principais aspectos envolvidos nos contratos de comercialização de energia elétrica no mercado livre, de forma direta e simples, para servir como um guia geral neste tipo de contratação, direcionado principalmente para aqueles que querem entender melhor o funcionamento e a dinâmica deste ambiente tão complexo e rico de detalhes. Além disso, aborda os principais desafios deste tipo de contratação e algumas alternativas que poderiam ser revistas pela regulamentação, para tornar mais simples os contratos e seus eventuais questionamentos.

The topic about the commercialization of the electric energy at the Electric Energy Trading Chamber is relatively new and complex and there are few agents and companies (even contractors), that really know deeply its functioning. Before the expansion of this market, as well as taking into account the opportunity of diminishing of the electric energy costs by the contracting undertakes and consequent and increased competitiveness, the discussion about regulation at the Trading Chamber is extremely important. The present paper work seeks to bring the main aspects involved at the electric energy trade contracts at the free market, in a direct and simple way, to serve as a general guide in this kind of contracting, mainly directed to the ones that would like to have a better understanding of the operation and dynamics of this rich of details and complex environment. Furthermore, it is approaching the main challenges in this type of contracting and some alternatives that could be reviewed by the regulation, in order to make it simpler the contract and it is eventually questionings.
