Intuição e decisão jurídica: uma análise da heurística da representatividade na tomada de decisão judicial

Abstract

O objetivo do presente trabalho é investigar a presença de fatores intuitivos no processo de tomada de decisão judicial. Especificamente, pretende-se investigar a influência da heurística da representatividade e a eventual ocorrência de erros de decisão. Para isso, foi realizada uma pesquisa empírica com base em estudos norte-americanos, reproduzindo um questionário contendo casos fictícios que estimulam a decisão com base na heurística da representatividade e aplicando-os para alunos e magistrados de forma que fosse possível traçar uma análise comparativa e que permitisse a investigação da hipótese de que a experiência ao longo da carreira no direito neutralizasse a influência de heurísticas e vises.

The purpose of this article is to investigate the presence of intuitive factors in the judicial decision-making process. Specifically, the objective is to investigate the influence of the representativeness heuristic and the possible occurrence of decision errors. For this, an empirical research was carried out based on North American studies, reproducing a questionnaire containing fictitious cases that stimulate the decision based on the heuristic of the representativeness and applying them to students and judges in such a way that it was possible to draw a comparative analysis and that would allow the investigation of the hypothesis that the experience during the law career neutralizes the influence of heuristics and vises.
