Judicialização para fornecimento liminar de medicamentos no Amazonas: tendências, conflitos e alternativas

Abstract

Objetivo - O objetivo geral desta pesquisa é analisar a concessão de tutela antecipada contra o Estado do Amazonas para fornecimento de medicamentos à luz da política pública em vigor, considerando as perspectivas dos atores públicos envolvidos neste processo. Metodologia – A abordagem é quali-quantitativa e os dados foram coletados por meio de pesquisa documental a respeito das ações ordinárias e das decisões judiciais. Aplicaram-se entrevistas semiestruturadas para verificar a perspectiva de cada ator e avaliar o desenvolvimento da cooperação entre eles, pelo acompanhamento de propostas para solução de conflitos. Os dados quantitativos coletados foram tratados utilizando-se indicador elaborado por Pepe e colaboradores (2011) e, os qualitativos, com o uso da técnica de análise de conteúdo. Resultados – No Amazonas as decisões que deferem tutela antecipada baseiam-se quase exclusivamente na prescrição medicamentosa apresentada e na urgência intrínseca à saúde (91,92%). A entrega de medicamentos não previstos na Portaria no 1.554/2013 ocorreu em 62,25%. Os efeitos negativos da judicialização são percebidos pela maioria dos atores públicos envolvidos. As ações de cooperação entre os Poderes são ainda embrionárias, demandando estudos futuros. Limitações – Os dados são extremamente pulverizados. A busca no sistema eletrônico de processos do TJAM (e-SAJ) se mostrou falha para identificação das ações exclusivas para fornecimento de medicamentos. O indicador de renda familiar também ficou prejudicado em razão da pouca informação registrada nos autos. Contribuições práticas – A pesquisa conseguiu consolidar os dados sobre o tema da judicialização de medicamentos no Estado do Amazonas e acompanhar, na visão de cada ator público participante do fenômeno, as iniciativas de cooperação entre eles. Pode servir como base para futuros estudos que ambicionem avaliar os resultados dessas medidas e como material para reflexão sobre a atuação dos Poderes Executivo e Judiciário amazonense. Contribuições sociais – Contribui para fixar o início de parâmetros para o diálogo entre Poder Executivo e Poder Judiciário e os gargalos eventualmente enfrentados para consecução da atuação em rede que se inicia. Originalidade – Pela primeira vez no estado do Amazonas, aplicou-se a proposta de matriz analítica do Manual de Indicadores de avaliação e monitoramento das demandas judiciais de medicamentos, e todos os magistrados das Varas de Fazenda foram entrevistados.

Purpose - The overall objective is to analyze the granting of early guardianship against the State of Amazonas for the supply of drugs in light of the current public policy, regarding the public actors’ perspectives involved in this process. Design/Methodology - The approach is quali-quantitative and the data was collected through documentary research regarding the common shares and judicial decisions with the concession of early protection. Semi-structured interviews were conducted to identify each actor's vision, as well as to evaluate the development of cooperation between them. The quantitative data was collected using an indicator developed by Pepe et al. (2011) and qualitative data using the content analysis technique. Findings - In Amazonas, the actions involving requests of medicine supply against the state are single requests of granting advance relief based almost exclusively on medical prescription and urgency intrinsic to health (91.92%). The granting of medication not belonging to the Administrative Rule no. 1.554/2013 occurred in 62.25%. It was found that the negative effects of judicial rulings are noticed by most of the public agents involved. The actions of cooperation between the Powers are still embryonic, demanding future studies. Limitations - The data is extremely pulverized. The search in the electronic system of processes of the TJAM (e-SAJ) proved to be flawed to identify the actions prosecuted exclusively for the supply of medicines. The family income indicator was also hampered by the lack of information recorded in the lawsuits. Practical implications - The research was able to consolidate the data on the judicialization of medicines subject in the State of Amazonas and to follow the cooperation initiatives in the view of each public actor participating in the phenomenon. It can serve as a basis for future studies that aim to evaluate these measures results and as a material for reflection on the performance of the Executive and Judiciary branches of Amazonia. Social implications – It contributes to set the beginning of parameters for the dialogue between Executive Power and Judiciary Power and the bottlenecks eventually faced to achieve the network action that begins. Originality: It was applied the analytical matrix proposal of the Manual of Indicators for evaluation and monitoring of drug lawsuits for the first time in the state of Amazonas and interviewed all the State Courts magistrates.
