A recorribilidade das decisões interlocutórias no procedimento comum do Novo Código de Processo Civil

Abstract

The appealability of the interlocutory decisions in the common procedure has undergone great changes with the advent of the New Code of Civil Procedure. Initially, the classification of the judge's pronouncements and the history of interlocutory appeal in previous legislations were discussed. The new system of Law 13.105/15 was studied with regard to the system of preclusion of art. 1.009, § 1 and art. 1.015, in order to discuss the hypotheses of interlocutory appeal and the use of substitutes means of challenge to object immediately interlocutory decisions.

A recorribilidade das decisões interlocutórias no procedimento comum sofreu grande mudanças com o advento do Novo Código de Processo Civil. Inicialmente, foi abordada a classificação dos pronunciamentos do juiz, em seguida, o histórico do tratamento do agravo de instrumento nas legislações anteriores. Foi estudado o novo sistema da Lei 13.105/15 no que tange o sistema de preclusões do art. 1.009, § 1ª e do art. 1.015, para, em um momento posterior, tratar das hipóteses do agravo de instrumento e do uso dos sucedâneos recursais como meio de impugnação imediata das decisões interlocutórias.
