Os limites dos negócios jurídicos processuais atípicos

Abstract

O presente trabalho busca analisar os Negócios Jurídicos Processuais atípicos, de cláusula geral no art. 190 do Novo Código de Processo Civil, inserido na nova perspectiva de cooperação do diploma processual. Assim, analisam-se os limites a serem impostos nas convenções, tanto pela redação do artigo, quanto relativos ao objeto em caráter amplo, aspecto no qual a lei é omissa. Além disso, busca-se compreender o papel o juiz na eficácia do negócio jurídico processual e a forma que se devem interpretar as convenções.

This paper analyses the atypical Procedural Convention, which is regulated by article 190 of the New Brazilian Civil Procedure Code inserted in the new perspective of the cooperation in the code. Therefore, it studies the limits to be applied on the transactions: the ones that are inferred by the text of the article and the ones about its objects, in general, which is not explicitly dictated in the rule. Furthermore, it tries to understand the role that the judge has in the effectiveness of the procedural transactions and how they must be interpreted.
