Interpretação constitucional dos antecedentes criminais

Abstract

O presente trabalho tem por objeto a análise crítica do instituto dos antecedentes criminais no ordenamento jurídico brasileiro. Busca-se, através de estudo doutrinário e jurisprudencial, examinar, descritiva e normativamente, suas nuances de aplicação, com enfoque dirigido à caracterização e à incidência temporal do referido instituto sobre a dosimetria penal. O trabalho resgata os conceitos fundantes que circunscrevem e permeiam o tema, trazendo, ao fim, posicionamento do autor frente às controvérsias que surgem desta análise.

This paper aims to provide a critical analysis of the criminal records institute within the borders of the brazillian criminal and constitutional law. By examining the doctrines and case law regarding this matter, this paper intends to further analyze, both descriptively and normatively, the variations provided by the different applications of the law depending on the judge or court who rules it, focusing on what characterizes bad criminal records and in the incidence of temporal limitations to that institute. This paper explains the fundamental concepts that define the institute`s specifies and provides the author`s input on the matter.
