Parassubordinação e subordinação estrutural enquanto soluções para a crise da subordinação: a perspectiva do Tribunal Superior do Trabalho

Abstract

Este trabalho busca descrever o atual momento que o Direito do Trabalho vive, chamado pela doutrina de 'Crise da Subordinação'. Como o próprio nome indica, a subordinação, conceito que é a espinha dorsal do Direito do Trabalho, tem sido considerada imprecisa e inapta para conceituar as modernas relações de trabalho, colocando em jogo toda a ciência Justrabalhista. Assim, o trabalho descreverá o instituto da subordinação, apontar suas limitações presentes e examinar as duas principais soluções que doutrinadores têm oferecido à chamada 'Crise da Subordinação', nominalmente os conceitos de 'Parassubordinação' e 'Subordinação Estrutural'. Finalmente, analisar-se-á como o Tribunal Superior do Trabalho tem enxergado os dois institutos.

This thesis seeks to describe the current state of the art of Brazilian Labor Law, regarded as the 'Subordination Crisis'. As the name implies, subordination, the concept at the core of Labor Law is currently being labelled as imprecise and inept to describe current labor relations, putting the whole science of Labor Law in jeopardy. Therefore, the current thesis will describe the concept of subordination, point its shortcomings and examine the two main solution presented by doctrine to the 'Crisis in Subordination', nominally the concepts of 'Parassubordination' and 'Structural Subordination'. Finally, it will be examined how the Superior Labor Court sees both institutes.
