A reforma gerencial e as agências reguladoras
Abstract
Neste artigo, avaliamos o papel das agências reguladoras após a Reforma Gerencial, ocorrida em 1995, analisando sua evolução institucional e sua autonomia. Para isso, apresentamos uma contextualização sobre a democracia republicana, a reforma da gestão pública e a criação das agências reguladoras no Brasil. A partir dessas bases, se destacam as inovações deste modelo de autarquia de regime especial, entre os quais a autonomia de gestão, independência decisória, a flexibilidade administrativa, identificando os obstáculos na concretização da autonomia prevista em lei, o possível impacto na atividade de regulação e os eventuais conflitos com o regime democrático. Toda esta discussão invoca também outras questões atinentes ao modelo de democracia republicana, as inovações trazidas pelas reformas no modelo de administração pública no Brasil e as mudanças subjacentes na relação entre o Estado e a sociedade, culminando na criação de novas instituições como as agências reguladoras. In this article, written through a case study, we evaluate the role of regulatory agencies after the Managerial Reform, which happened in 1995, analyzing its institutional evolution and its autonomy. In order to achieve that, we contextualize republican democracy, the reform of public management and the creation of regulatory agencies in Brazil. Based on that, the innovations of this model of special regime autarchy, among them the autonomy of management, independence of decision making, administrative flexibility, identifying the obstacles in the implementation of the autonomy provided by law, the possible impact on the regulation activity and any conflicts with the democratic regime. This discussion also brings up other discussions: the model of republican democracy, the innovations brought about by the reforms in the model of public administration in Brazil and the underlying changes in the relationship between the State and society, culminating in the creation of new institutions such as regulatory agencies.
