Judicialização da saúde: a questão da perícia técnica

Abstract

A Judicialização da Saúde tem se mostrado cada vez mais presente na esfera pública, afetando direta e indiretamente todos os cidadãos brasileiros uma vez que se gasta milhões anualmente com as liminares individuais obtidas por meio do judiciário. Sabendo também que o orçamento público é finito e tem que ser bem pensado para não faltar no tratamento e cuidados da população, o tema acima é vital já que se trata de atender uns em detrimentos de outros. O cerne deste paper é debater a forma como o poder judiciário lida antes de liberar uma liminar, quais são os meios e os fundamentos técnicos envolvidos e analisados pelos julgadores se são baseados em questões relevantes ou levados em conta o coração. O custo-benefício também é levantado neste paper já que seria uma boa saída para os órgãos julgadores terem em mente todos os benefícios que um eventual tratamento ou medicamento gerará ao paciente prescrito.

The Judicialization of Health is increasingly present in the public sphere, affecting directly and indirectly all Brazilian citizens since millions are spent annually as injunctions individuals obtained through the judiciary. Knowing also is what is a public and finite budget and has to be well thought out not to miss without treatment and health care, the above topic is vital since it is about satisfying others at the detriment of others. The crux of this paper is to discuss how the judiciary deals before releasing an injunction, which are the means and technical foundations involved and analyzed by the judges whether they are based on relevant or heart-felt issues. The cost-benefit is also raised in this paper as it would be a good way for the judging bodies to keep in mind all the benefits that a possible treatment or medicine will generate to the prescribed patient.
