Regulação setorial e defesa da concorrência: o caso da distribuição e revenda de combustíveis
Abstract
O objetivo do presente trabalho é apresentar um breve estudo sobre a interação entre as esferas setorial e concorrencial no setor de petróleo, gás natural e biocombustíveis, abarcando uma análise dos limites e da cooperação entre os órgãos reguladores e as autoridades antitruste com foco no mercado de distribuição e revenda de combustíveis. Para tanto, inicialmente serão explorados aspectos conceituais e doutrinários em relação às competências conferidas a tais órgãos e autoridades no plano teórico, será analisada jurisprudência norte-americana relevante no tocante aos limites da atuação das entidades participantes das duas esferas e serão examinadas restrições regulatórias à concorrência nos setores regulados supracitados. Por fim, ações coordenadas entre o CADE e a ANP em tais segmentos serão destacadas e serão apresentadas considerações acerca do atual sistema de interação entre regulação setorial e defesa da concorrência nos setores de petróleo, gás natural e bicombustíveis. The goal of this paper is to present a brief study on the interaction between the sectoral regulation and the antitrust spheres on the oil, natural gas and biofuel industry, covering an analysis of the limits and the cooperation between the regulatory bodies and antitrust authorities, with a focus on the fuel market. For this purpose, conceptual and doctrinal aspects in relation to the powers conferred on such bodies and authorities will be explored under a theoretical point of view, relevant U.S. jurisprudence will be analyzed regarding the limits of the performance of the entities participating in the two spheres and regulatory restrictions on competition will be examined in regards to the regulated sectors abovementioned. Finally, coordinated actions between CADE and ANP will be highlighted and considerations about the current system of interaction between sectoral regulation and defense of competition in the oil, natural gas and biofuel sectors will be presented.
